 From the COPYRIGHT file in the madwifi tarball:

  * Alternatively, this software may be distributed under the terms of the
  * GNU General Public License ("GPL") version 2 as published by the Free
  * Software Foundation.

Even if it weren't GPL-compatible, it is not illegal to use, it is just 
a breach of contract if you DISTRIBUTE non-GPLed packages bundled with 
GPLed packages.

MadWifi also works great on my MacBook's wifi card.
